Terms of Use

These are the rules for using Gofy. By creating an account or using the app you agree to them. If you do not agree, please do not use Gofy.
The short version. Post real things you have actually seen. Treat other people decently. Do not fake your location, run extra accounts, or otherwise game the system to pull money out of it — we will take the money back and close the account. Subscriptions are billed by Apple or Google and you cancel them there. The free tier shows ads.
1. Who we are, and who can use Gofy
Gofy is operated from Barcelona, Spain. You must be at least 13 years old, or older if the law where you live requires it, and you must have the legal capacity to enter into this agreement. One person, one account. Business accounts must be created by someone authorised to act for that business.
2. What Gofy is, and what it is not
Gofy is a map of things happening near you, written by the people around you. Gems are places and offers users post. Safety reports are observations users add to the map.
None of it is verified fact, and none of it is professional advice. A report that says there was a pickpocket on a corner means somebody said so. It is not a finding that a crime occurred, and it is not an accusation against any identifiable person or business. Use your own judgement, and in an emergency call the emergency services, not an app.
3. Your account
You are responsible for your account and for anything done through it. Keep your login details to yourself, and tell us promptly if you think someone else has access. Do not impersonate anyone, and do not claim a business, handle or venue you have no right to.
4. Community rules
Gofy carries content written by its users, and we have no tolerance for abusive material. Do not post, send or upload:
- Harassment, bullying, threats, or content that targets someone because of who they are.
- Hate speech, or content that promotes violence or self-harm.
- Sexual content, nudity, or anything involving minors in a sexual context.
- Content that is illegal, or that facilitates or encourages illegal activity.
- Spam, scams, phishing, malware, or bulk unsolicited messages.
- Someone else's personal information — a name, face, phone number, address or number plate — without their consent. This includes naming or identifying individuals in a safety report.
- Content you do not have the rights to, including other people's photos.
- Deliberately false gems or safety reports, including reports made to damage a business or to scare people away from a place.
Safety reports exist so people can look after each other. Using them to accuse, target or defame anyone is a serious breach of these Terms.
5. Reporting content, and blocking people
Every piece of user content in Gofy can be reported from the app. We review reports and act on them, normally within 24 hours, and we remove content that breaks the rules. You can also block any user, which stops them messaging you; a block can only be lifted by the person who made it.
We act on breaches proportionately: removing content, withholding earnings connected to it, limiting an account's ability to post, suspending it, or terminating it. Accounts that breach the rules repeatedly, or once in a serious enough way, are terminated and not re-admitted. You can appeal a decision by writing to [email protected].
6. Your content
What you post stays yours. By posting it you give us a non-exclusive, worldwide, royalty-free licence to host, store, translate, resize, display and distribute it for the purpose of operating and promoting Gofy. That licence ends when you delete the content, except for copies already made by other users and copies we must keep by law.
You confirm you have the right to post what you post, and that it does not infringe anyone else's rights. The Gofy name, logo and design are ours.
7. Earnings, Flash and payouts
Gofy shares subscription revenue with the people who make it worth subscribing to.
- The pool. A fixed share of subscription revenue — currently 30 per cent — funds a monthly creator pool. What you earn is a share of that pool, not a fixed fee per action, so the value of a point depends on how much revenue came in and how many people earned that month.
- How you earn. By posting gems other people verify, and by verifying gems yourself. A gem earns for a limited window after it is posted, and each account can hold only a limited number of earning gems at once. The current figures are shown in the app.
- Verification means presence. A verification counts only if your device shows you were physically at the place, inside the geofence, for the required time, with enough position updates and acceptable accuracy. Positions your operating system reports as mocked are rejected.
- Flash is an in-app points balance earned for actions like verifying a gem or having a report confirmed. Flash has no cash value, cannot be exchanged for money, and can be adjusted or removed if it was earned in breach of these Terms.
- Payouts. Earnings are held for a settlement period before they can be withdrawn, and you need an eligible plan, a valid payout account and a balance at or above the minimum shown on your Earnings screen. Requesting a payout does not create a debt we owe you until it is approved and settled.
- Withheld earnings. Earnings on a gem that has been reported or downvoted for being wrong, misleading or inappropriate are held while we review it. If the complaint stands, those earnings are cancelled.
- Taxes are yours. You are responsible for declaring and paying any tax on what you earn.
- We may change the pool share, rates, thresholds and windows. Changes apply going forward, never to earnings you have already settled.
8. Manipulation and fraud
The pool is finite. Every euro taken by someone gaming the system is a euro taken from someone who walked to a place and posted something real. So this section is enforced strictly.
You must not:
- Falsify your location by any means — mock-location apps or developer settings, GPS simulators, emulators, rooted or jailbroken automation, VPN or hardware tricks, or any other method of appearing to be somewhere you are not.
- Create or use more than one account, or use somebody else's account, to verify your own gems, to vote on your own content, to claim referral rewards, or to multiply any allowance or reward.
- Arrange for others to verify, vote, confirm or report in a coordinated way, whether by payment, exchange, group instruction or any other arrangement. Both sides of such an arrangement are in breach.
- Use bots, scripts, automation, or modified clients, or call our API directly to perform actions a person would otherwise have to perform in the app.
- Post gems for places that do not exist, that you have invented, that duplicate an existing gem for the same venue, or that exist mainly to be verified rather than to be visited.
- File safety reports that are untrue, or confirm and deny reports without being there, or use the report system to attack a business or a person.
- Interfere with other people's earnings — mass downvoting, false reporting, or any attempt to disqualify a competitor's content.
- Exploit a bug, pricing error or loophole instead of reporting it. If you find one, tell us at [email protected]; we would much rather hear from you, and we will not penalise a good-faith report.
- Reverse engineer, decompile or tamper with the app, or attempt to bypass any limit, rate limit or security control in it.
What happens if you do. We use automated checks and manual review to detect manipulation. Where we find it, or reasonably believe we have found it, we may: reject or reverse the affected verifications, votes, reports and earnings; withhold a payout while we investigate; cancel the balance obtained in breach, including Flash; remove the content; suspend the account; or terminate the account permanently and refuse to serve you again. Where a payout was already made on manipulated activity, we may recover it. Serious cases may be reported to the authorities.
We will tell you when we take action on your account and you may appeal to [email protected]. We do not publish the specifics of our detection methods, because publishing them would defeat them.
9. Subscriptions and purchases
- Who bills you. Subscriptions and one-off purchases made in the app are sold and billed by Apple or Google, under their terms, not by us. We never see your payment details.
- Auto-renewal. Subscriptions renew automatically for the same period at the price shown, and are charged to your store account, until you cancel. Cancel at least 24 hours before the end of the current period or the next one is charged.
- How to cancel. In your App Store or Google Play account settings. We cannot cancel a store subscription for you. Cancelling stops the next renewal; it does not shorten the period you have already paid for, and access continues to the end of it.
- Free trials. Where a trial is offered, it converts into a paid subscription unless you cancel before it ends. Unused trial time is lost if you subscribe earlier.
- Refunds are handled by the store that took your money, under its policy. Ask us and we will help, but the decision is theirs, not ours.
- One-off purchases such as boosts and pin images are consumable: once spent on a gem they are used up and are not refundable by us. Unspent credits stay on your account.
- What you get. A paid plan unlocks the features listed on the plan screen at the time you buy. If a purchase does not appear, use Restore Purchases; if it still does not, contact us.
- Price changes. We may change prices. Changes are notified through the store before they take effect, and never apply to a period already paid for.
- Ending a plan. If your plan lapses, your earned balance is not taken from you, but cashing out requires an eligible plan.
10. Advertising
The free tier is supported by advertising, supplied by Google AdMob. Ads inside the app are labelled as sponsored. Whether the ads you see are personalised depends on the consent choice you make when asked, which you can change in your device settings at any time; see our Privacy Policy. A paid subscription removes ads. We do not endorse advertised products, and we are not party to any dealing between you and an advertiser.
11. Business accounts
If you claim or operate a venue on Gofy, you confirm you are authorised to represent it, and that the information you publish about it is accurate. Business plans, boosts and analytics are subject to the same billing terms in section 9. We may remove a claim we believe to be false, and may verify a claim before granting it.
12. Availability
We may change, suspend or discontinue any part of Gofy, and we may set or adjust limits on use. We try to give notice of significant changes, but we may act immediately where security, legal compliance or abuse requires it. Gofy depends on your device, your network and third-party services; we do not promise it will always be available or error free.
13. Ending this agreement
You may stop using Gofy and delete your account at any time from the app's settings. We may suspend or terminate an account that breaches these Terms, as described in sections 5 and 8, or where we are required to by law. Sections that by their nature should survive termination — content licences already granted, liability, and governing law — do survive it.
14. Disclaimers and liability
Gofy is provided "as is". To the fullest extent the law allows, we make no warranties about the accuracy, safety or availability of user content, including gems and safety reports, and we are not liable for indirect or consequential loss, lost profits, or loss arising from your reliance on something another user posted.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer in the EU, you keep all the statutory rights your local law gives you, and nothing here overrides them.
15. Changes to these Terms
We may update these Terms. If a change is significant we will tell you in the app and update the date at the top, and where the law requires it we will ask you to accept the new version. Continuing to use Gofy after a change means you accept it.
16. Governing law
These Terms are governed by Spanish law. Disputes go to the courts of Barcelona, Spain. If you are a consumer resident in the EU, you may instead bring proceedings in the courts of the country where you live, and you keep the protection of its mandatory consumer law.
